These Terms of Service (“Terms”) govern your access to and use of thefadedepartment.com, The Fade Department’s online services, content, live streams, forms, interactive features, and other services operated by The Fade Department (“TFD,” “we,” “us,” or “our”).

By accessing or using our services, you agree to these Terms. If you do not agree with these Terms, please do not use the services.

1. Eligibility and Acceptance

You must be legally capable of agreeing to these Terms in your jurisdiction. If you are under the age of legal majority where you live, you may use the services only with the permission and supervision of a parent or legal guardian where required by law.

Certain promotions, giveaways, payment features, third-party services, or other features may have additional age or eligibility requirements.

2. The Fade Department Services

The Fade Department is a live entertainment and media platform featuring content that may include boxing commentary, gaming, reactions, IRL content, livestreams, clips, community participation, and other original or curated entertainment.

We may add, change, suspend, restrict, or discontinue any portion of the services at any time. Availability of a particular feature is not guaranteed.

3. Acceptable Use

You agree to use our services lawfully and responsibly. You may not use The Fade Department to violate applicable law, infringe the rights of others, interfere with the operation or security of the services, attempt unauthorized access, distribute malicious software, impersonate another person, submit fraudulent information, abuse promotional programs, or use automated systems in a manner that disrupts the services.

We may restrict or block access when reasonably necessary to protect our services, users, community, systems, or legal rights.

4. Intellectual Property

Unless otherwise stated, The Fade Department’s branding, logos, graphics, designs, original videos, streams, commentary, written content, site design, software, and other original materials are owned by or licensed to The Fade Department and are protected by applicable intellectual property laws.

You may access our content for personal, lawful viewing and interaction. You may not reproduce, sell, redistribute, falsely claim ownership of, or commercially exploit our original materials without permission unless permitted by applicable law.

5. Commentary and Third-Party Content

The Fade Department may discuss, review, react to, critique, or reference third-party events, games, broadcasts, social media posts, footage, products, personalities, or other materials. Ownership of third-party trademarks and content remains with their respective owners.

References to a third party do not necessarily indicate sponsorship, endorsement, affiliation, or partnership with The Fade Department.

6. User Submissions and Community Content

You are responsible for information, messages, comments, media, usernames, display names, or other content you voluntarily submit through our services.

By submitting content for public display, livestream interaction, TTS playback, community participation, or similar features, you give The Fade Department permission to display, transmit, reproduce, or otherwise use that submission as reasonably necessary to operate the feature you selected.

You must not submit material that you do not have the right to provide or content that is unlawful, threatening, fraudulent, malicious, infringing, or intended to disrupt the service.

7. TTS, Viewer Support, and Paid Interactive Features

The Fade Department may offer paid viewer-support or interactive features, including text-to-speech (“TTS”) messages, message displays, media interactions, or similar features. The applicable price and available features will be shown before a transaction is completed.

Payments may be processed through independent third-party payment providers. Your use of those payment services may also be subject to the provider’s terms, privacy practices, and payment-processing requirements.

Submitting payment does not guarantee that a message, image, sound, or other submission will be displayed or played. The Fade Department may reject, remove, interrupt, or decline content that violates these Terms, applicable platform rules, community standards, law, technical limitations, or reasonable moderation requirements.

Except where required by law or otherwise stated at checkout, completed viewer-support transactions and digital interactive services may be non-refundable once the requested service has been delivered or processing has begun.

8. Third-Party Services and Links

Our services may contain links to, embeds from, integrations with, or functionality provided by independent third parties. These may include social networks, payment providers, streaming platforms, video services, analytics services, hosting providers, and other technology providers.

We do not control independent third-party services and are not responsible for their availability, security, content, policies, or practices.

9. Giveaways, Sweepstakes, and Promotions

The Fade Department may conduct giveaways, sweepstakes, contests, or other promotions. Each promotion may be governed by separate eligibility requirements, entry procedures, deadlines, prize terms, winner-selection procedures, and other conditions.

If there is a conflict between these Terms and the Official Rules for a specific promotion, the applicable Giveaway Official Rules control with respect to that promotion. Information about how personal information is handled in connection with a promotion is described in the applicable Giveaway Privacy Notice.

10. Privacy

Our collection and use of personal information is described in our Privacy Policy.

11. Account and Credential Security

If you are provided access to an account, administrative feature, connected service, or private TFD tool, you are responsible for maintaining the confidentiality of your credentials and for promptly notifying us if you believe unauthorized access has occurred.

12. Service Availability

We work to maintain reliable services, but we do not guarantee uninterrupted or error-free operation. Features may be temporarily unavailable because of maintenance, internet outages, software errors, third-party service interruptions, platform API changes, security events, or other circumstances.

13. Disclaimers

The Fade Department’s content is provided primarily for entertainment, commentary, discussion, and informational purposes. Opinions expressed in commentary are opinions and should not be treated as professional legal, financial, medical, or other licensed professional advice.

To the extent permitted by applicable law, the services are provided on an “as is” and “as available” basis without warranties of uninterrupted availability or that every error will be corrected.

14. Limitation of Liability

To the maximum extent permitted by applicable law, The Fade Department will not be liable for indirect, incidental, special, consequential, or punitive damages arising from or related to your use of, inability to use, or reliance on our services or independent third-party services.

Nothing in these Terms excludes or limits liability where such limitation or exclusion is prohibited by law.

15. Responsibility for Your Use

You are responsible for your use of the services and for content or information you submit. To the extent permitted by law, you agree to be responsible for claims, losses, or expenses resulting from your unlawful use of the services, your violation of these Terms, or your infringement of another person’s rights.

16. Suspension or Termination

We may suspend or terminate access to specific services when reasonably necessary because of a violation of these Terms, suspected fraud or abuse, security concerns, legal requirements, or actions that materially interfere with our services or community.

17. Governing Law

These Terms are governed by the laws of the State of Michigan, United States, without regard to conflict-of-law principles, except where applicable law requires otherwise.

18. Changes to These Terms

We may update these Terms from time to time. When changes are made, the revised Terms will be posted on this page and the “Last updated” date will be updated.

19. General Legal Terms

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in effect to the extent permitted by law.

Our failure to enforce a provision of these Terms does not waive our right to enforce that provision or any other provision in the future.

These Terms, together with any additional terms, policies, or Official Rules that expressly apply to a particular TFD service or promotion, constitute the applicable agreement between you and The Fade Department concerning your use of those services.
